Welcome to AllPetsSpot.com (“Platform,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the AllPetsSpot.com website, services, and applications. By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.
1. Nature of the Platform
AllPetsSpot.com operates as a neutral online marketplace connecting pet owners (“Pet Owners”) with independent providers of pet care services (“Caregivers”). We provide the technology to facilitate connections, bookings, and payments.
We do not provide pet care services. Caregivers are independent contractors, not employees, agents, or representatives of AllPetsSpot.com. We do not direct or control the Caregivers, and we make no representations or warranties regarding the quality, safety, or legality of the services provided. Your interactions and transactions with other users are solely at your own risk.
2. User Accounts and Responsibilities
To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
2.1 Pet Owner Responsibilities
•You certify that your pets are up-to-date on all required vaccinations, licensed, and tagged in accordance with local laws.
•You agree to disclose any behavioral issues, medical conditions, or history of aggression regarding your pet prior to booking.
•You are responsible for paying all fees associated with a confirmed booking.
2.2 Caregiver Responsibilities
•You certify that you are legally eligible to provide pet care services in your jurisdiction.
•You agree to provide services safely, professionally, and in accordance with the terms agreed upon in the booking.
•You are solely responsible for obtaining any necessary licenses, permits, or insurance required to operate your pet care business.
2.3 Background Checks and Identity Verification
AllPetsSpot.com requires Caregivers to undergo identity verification and a comprehensive background check prior to offering services on the Platform.
•By registering as a Caregiver, you consent to AllPetsSpot.com (and our authorized third-party consumer reporting agencies) conducting criminal background checks, identity verification, and other screening processes.
•You agree to provide accurate information, including your Social Security Number (or equivalent government ID), to facilitate these checks.
•AllPetsSpot.com reserves the right to approve, deny, suspend, or terminate any Caregiver account based on the results of these background checks, in our sole discretion and in accordance with applicable law (including the Fair Credit Reporting Act).
•Pet Owners acknowledge that while we require background checks, no screening process is perfect. AllPetsSpot.com does not guarantee the absolute safety or suitability of any Caregiver. Pet Owners must exercise their own judgment when booking services.
3. Bookings, Fees, and Payments
3.1 Booking Process
A transaction is formed when a Pet Owner and a Caregiver agree to a booking via the Platform. Once a booking is confirmed, both parties are obligated to honor the agreed-upon price, dates, and services.
3.2 Platform Fees and Commissions
AllPetsSpot.com charges a service fee to maintain and operate the Platform.
•Caregiver Commission: We deduct a 10% commission from the total booking amount paid to the Caregiver. The remaining 90% is disbursed to the Caregiver’s connected Stripe account.
•All fees are clearly displayed prior to confirming a booking.
3.3 Payment Processing
All payments must be processed through our authorized third-party payment processor (Stripe). By using the Platform, you agree to Stripe’s terms of service. We authorize and capture payment at the time of booking and disburse funds to the Caregiver according to our payout schedule.
4. Prohibition of Off-Platform Payments
To maintain the safety, security, and viability of the Platform, all payments for services arranged through AllPetsSpot.com must be processed through the Platform.
4.1 The Rule
You agree not to use the Platform to find a Caregiver or Pet Owner and then complete the transaction offline or through another payment method (e.g., cash, Venmo, Zelle, PayPal) to avoid paying Platform fees.
4.2 Communication Restrictions
Prior to a confirmed and paid booking, users are prohibited from sharing direct contact information, including phone numbers, email addresses, social media handles, or physical addresses, through the Platform’s messaging system.
4.3 Penalties for Violation
If we determine, in our sole discretion, that you have engaged in or attempted to engage in off-platform payments, we reserve the right to:
1.Immediately suspend or permanently terminate your account.
2.Charge a penalty fee equal to the commission we would have earned on the transaction.
3.Void any platform protections, guarantees, or customer support associated with the transaction.
5. Cancellations and Refunds
Cancellations are governed by the specific cancellation policy selected by the Caregiver at the time of booking.
•If a Caregiver cancels a booking, the Pet Owner will receive a full refund.
•If a Pet Owner cancels, refunds are issued according to the Caregiver’s stated policy. Platform service fees may be non-refundable.
6. Emergencies and Veterinary Care
In the event of a medical emergency involving a pet, the Caregiver must make reasonable efforts to contact the Pet Owner and their designated emergency contact. If the Pet Owner cannot be reached, the Caregiver is authorized to seek emergency veterinary care. The Pet Owner is solely responsible for all costs associated with such veterinary treatment.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALLPETSSPOT.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS; OR (C) ANY SERVICES PROVIDED BY CAREGIVERS.
8. Indemnification
You agree to indemnify, defend, and hold harmless AllPetsSpot.com, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your interaction with any other user.
9. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on the Platform and updating the “Effective Date.” Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
